This Privacy Policy applies to the Know Your Lemons website and mobile app. We collect only the information needed to provide, secure, understand, and improve our Services. We do not sell personal information or permit third parties to use it for their own marketing.
1. Who We Are
Know Your Lemons Foundation, Inc. ("Know Your Lemons," "we," "us," or "our") is a nonprofit organization providing breast health education. We operate knowyourlemons.org and related websites (the "Website") and the Know Your Lemons mobile application (the "App"). Together, these are the "Services." We are the controller of personal information described in this Policy unless we tell you otherwise at the point of collection.
2. Scope
This Policy explains what personal information we collect through the Services, why we use it, when it may be disclosed, how we protect it, and the choices and rights available to you. A separate notice may apply to a particular program, survey, research project, donation, course, employment application, or partner-operated service. If a separate notice conflicts with this Policy, the more specific notice controls for that activity.
3. Information We Collect
Information you provide. Depending on how you use the Services, you may provide an email address and other account details; information entered into App features relating to breast health, risk, screening, symptoms, menstrual cycles, self-exams, reminders, goals, or educational progress; communications and support requests; newsletter preferences; survey or feedback responses; donation or transaction details; and information submitted through forms.
Information about family members. Some risk-assessment features may ask about family health history. Please provide only the information needed for the assessment and do not include relatives' names or contact details. You are responsible for having an appropriate basis to provide information about another person.
Information collected automatically. When you use the Services, we and service providers working for us may collect device and usage information such as IP address, browser type, device type, operating system, App version, language, approximate location derived from IP address, referring page, pages or features used, dates and times, session information, diagnostic information, and crash or performance data. The Website may use cookies, pixels, local storage, and similar technologies. Where required, we request consent before using non-essential technologies.
Information from other sources. We may receive information from organizations that help us operate programs, process donations, manage events, or provide the Services, but only as permitted by law and any notice given to you.
4. How We Use Information
We use personal information to provide, personalize, maintain, secure, and troubleshoot the Services; create and manage secure App accounts; generate educational results, reminders, risk information, and screening guidance requested by users; save progress and settings across devices; respond to questions and support requests; send operational messages; send newsletters or fundraising communications when permitted; process donations and transactions; understand engagement and evaluate educational impact; improve content, accessibility, design, and performance; detect fraud, misuse, and security incidents; comply with law and enforce our terms; and establish, exercise, or defend legal claims.
We may use aggregated or de-identified information for research, reporting, fundraising, program evaluation, and improvement. We take reasonable measures intended to prevent de-identified information from being associated with an individual. We will not publicly report results in a form intended to identify you.
We do not use health-related information from the App for targeted advertising, and we do not permit service providers to use it for their own advertising or unrelated purposes.
5. Legal Bases for Processing
Where data-protection law requires a legal basis, we rely on one or more of the following: your consent, including explicit consent where required for health-related information; performance of our agreement with you, such as providing your account and requested App features; our legitimate interests in operating, securing, evaluating, and improving the Services, where those interests are not overridden by your rights; compliance with legal obligations; and protection of vital interests or legal claims where applicable.
You may withdraw consent at any time. Withdrawal does not affect processing already carried out lawfully, and it may mean that a feature requiring the information can no longer be provided.
6. Analytics, Cookies, and Similar Technologies
We use analytics and performance tools to understand how the Services are used, measure educational engagement, identify technical problems, and improve our work. These tools may process device and usage information on our behalf. We configure them, where reasonably available, to limit collection and use of personal information.
We may use essential technologies without consent where allowed because they are needed for security, account access, preferences, or basic operation. Where required by law, non-essential analytics and similar technologies are used only after consent. You can manage available choices through our cookie settings, browser controls, device settings, or App permissions. Blocking some technologies may affect functionality.
The specific providers and technologies in use may change as our Services develop. Current information about Website cookies and similar technologies should be made available through the Website's cookie settings or cookie notice.
7. When We Disclose Information
We do not sell personal information. We do not disclose personal information to third parties for their own marketing, targeted advertising, or other independent purposes.
We may disclose information in the following limited circumstances:
Service Providers. To carefully selected providers that perform services for us, such as website and App hosting, cloud storage, secure account management, analytics, communications, customer relationship management, forms and surveys, payment processing, security, data backup, and technical support. They may process information only as necessary to provide contracted services to us, subject to appropriate confidentiality, security, and data-protection obligations.
With Your Permission. To another organization or person when you direct us to do so or give prior permission for the particular disclosure. Where required, we will explain what will be disclosed, to whom, and why before asking for permission.
Legal, Safety, And Security Reasons. When reasonably necessary to comply with applicable law, regulation, court order, or lawful governmental request; protect the rights, safety, and security of users, the public, Know Your Lemons, or others; investigate misuse or fraud; or establish, exercise, or defend legal claims.
Organizational Change. In connection with a merger, restructuring, transfer, or similar organizational transaction, subject to appropriate safeguards and applicable law. We will not treat such a transaction as permission to use health-related information for unrelated commercial purposes.
We may disclose aggregated or de-identified information that does not reasonably identify an individual, including program reach and impact metrics.
8. Secure Accounts and Information Security
The App provides a secure account intended to protect information and allow users to access saved features. We use reasonable administrative, technical, and organizational safeguards appropriate to the nature of the information, which may include access controls, encryption, secure development and hosting practices, monitoring, and limits on staff and provider access.
No method of transmission or storage is completely secure. You are responsible for keeping your login credentials confidential, using a strong and unique password, and notifying us if you believe your account has been compromised.
9. Retention
We keep personal information only for as long as reasonably necessary for the purposes described in this Policy, including while your account remains active, and as needed for security, fraud prevention, dispute resolution, legal compliance, and enforcement of agreements. Retention periods vary according to the type of information, the reason it was collected, and applicable legal requirements.
When information is no longer needed, we delete or de-identify it. Copies may remain temporarily in protected backups until they are overwritten through our normal backup cycle. We may retain aggregated or de-identified information that no longer reasonably identifies you.
10. Your Choices and Rights
Account information. You may review or update available account information within the App. You may manage device permissions through your device settings.
Account deletion. You may delete your account using the account-deletion function in the App. Deleting the App from your device does not delete your account. When you request account deletion, we delete or de-identify personal information associated with the account, subject to limited information we must or are permitted to retain for legal, security, fraud-prevention, or recordkeeping reasons. Information may remain temporarily in protected backups as described above.
Communications. You may unsubscribe from marketing or fundraising emails using the link in the message. We may still send essential account, security, transactional, or service messages.
Privacy rights. Depending on where you live, you may have rights to be informed; request access to or a copy of personal information; correct inaccurate information; request deletion; restrict or object to processing; withdraw consent; obtain portable data; opt out of certain disclosures, targeted advertising, or profiling; and appeal a decision on a privacy request. You may also have the right to complain to your local data-protection authority. We will not discriminate against you for exercising applicable privacy rights.
To make a request, contact us via the contact form with the subject line "Privacy Request." We may take reasonable steps to verify your identity and authority. An authorized agent may submit a request where permitted by law.
11. Consumer Health Information
Some information you choose to enter may constitute consumer health data or sensitive personal information under applicable law. We collect this information directly from you to provide the App features you request, such as breast-health education, risk information, screening guidance, reminders, and personal tracking tools. We may derive results or recommendations from your entries using established rules or assessment methods.
We do not sell consumer health data. We disclose it only to service providers necessary to provide and secure the Services, when required for legal or safety reasons, or with the specific permission or authorization required by applicable law. You may request access, correction, or deletion as described above and may withdraw consent where processing is based on consent.
12. International Data Transfers
Know Your Lemons is based in the United States, and information may be processed in the United States and other countries where our service providers operate. Those countries may have different data-protection laws from your country. Where required, we use appropriate safeguards for international transfers, such as approved contractual protections, adequacy mechanisms, or other lawful transfer methods.
13. Children and Teen Users
The Services are not directed to children under 13, and we do not knowingly create individual accounts for children under 13. Users ages 13 through 17 may use the Services only if permitted under the laws where they live and with consent from a parent or guardian where required. If local law requires parental consent for a user older than 13, that requirement applies.
If we learn that we collected personal information from a child without required consent, we will take reasonable steps to delete it. A parent or guardian may contact us via our contact page.
14. External Services and Links
The Services may link to social networks, app stores, payment services, healthcare resources, booking services, or other websites and applications that we do not control. Their privacy practices are governed by their own notices. A link does not mean that we are responsible for the external service's handling of information.
15. Medical and Educational Notice
The Services provide general educational information and tools. They do not provide medical diagnosis or treatment and are not a substitute for advice from a qualified healthcare professional. Do not delay seeking professional care because of information provided through the Services. If you believe you may have a medical emergency, contact local emergency services.
16. Changes to This Policy
We may update this Policy to reflect changes in the Services, our practices, or applicable law. We will post the updated Policy and change the effective date. If changes materially affect how we use information, we will provide additional notice or request consent when required.
